Terms of Service

01 Acceptance of Terms

These Terms form a binding agreement between you and 3SA. Acceptance occurs when the first of the following happens:

• You submit a contact, corporate, or inquiry form on the Site.
• You initiate a paid booking, intake, or service-tier purchase through the Site.
• You exchange written confirmation (email) with a 3SA representative authorizing a scope of work.

3SA reserves the right to decline, suspend, or terminate any engagement at its sole discretion, including where the requested work would violate applicable law, professional licensing rules, or these Terms.

02 Definitions

For the purposes of these Terms:

• "Engagement" means each specific case, consultation, or service package that 3SA accepts from a Client pursuant to a written scope of work.
• "Deliverable" means any final report, written intelligence brief, written summary, or written advisory memo produced for a Client as the output of an Engagement.
• "Subject" means the natural person who is the focus of an investigative or skip-tracing Engagement.
• "OSINT" means open-source intelligence: information lawfully gathered from public records, public databases, public social media, and widely distributed media.
• "Site" means the website www.verifiedby3sa.com and any subpages, gated acknowledgments, or intake portals operated by 3SA.
• "Vehicle & Asset Locate Intelligence" means 3SA's remote intelligence and location verification service that provides actionable address intelligence for client-supplied vehicles (and, by extension, the registered owners or current possessors identified in intake) for the client's hand-off to local law enforcement, legal counsel, or licensed repossession teams. The Deliverable is address intelligence only.

03 Services and the No-AI Work Policy

3SA Services include remote security consulting, OSINT-based Digital Footprint Investigations, skip tracing, background-check support, retrieval work, vehicle and asset locate intelligence, and corporate pre-placement vetting. Specific service tiers, deliverables, pricing, and turnaround are described on the Services, Pricing, and intake pages of the Site.

Service Scope

• Remote-First Delivery: All 3SA Services are delivered remotely.
• Public and Open-Source Data Only: 3SA analyzes publicly available information, OSINT, and lawful third-party commercial databases. 3SA does not engage in hacking, pretexting, surveillance in contravention of law, or unauthorized access to private accounts.
• No Legal Advice: Deliverables are investigative and informational in nature. 3SA is not your attorney and does not provide legal advice, legal representation, or attorney–client privileged work product.
• Vehicle & Asset Locate Boundary: Operational Note: 3SA LLC provides remote intelligence and location verification services. We deliver actionable address intelligence for clients to hand directly to local law enforcement, legal counsel, or licensed repossession teams. 3SA LLC does not perform physical asset repossession or field towing services.

No-AI Work Policy

3SA maintains an absolute No-AI Work Policy. We do not use artificial intelligence for any work-related tasks, including but not limited to casework, target identification, database analysis, image or video analysis, transcription, summarization, or report writing. Every step of the investigative process—from intake triage to final Deliverable drafting—is conducted manually by our Lead Investigator.

This policy guarantees absolute data containment for our Clients. No Client-provided data, intake details, target identifiers, case notes, or Subject information is ever exposed to, processed by, ingested into, or leaked into public or private generative AI tools, large language models, or third-party AI training pipelines.

04 Client Obligations

By engaging 3SA, you represent, warrant, and agree that:

• Lawful Purpose: You have a lawful purpose for requesting the Services, and the information you provide is not intended to be used for stalking, harassment, identity theft, fraud, blackmail, discrimination, or any conduct prohibited by federal or state law.
• Accurate Intake: All identifying details, prior known addresses, prior known phone numbers, employment, and other facts you provide in intake are accurate to the best of your knowledge. 3SA is not responsible for investigation delays or false leads attributable to inaccurate intake.
• Authority to Engage: If you engage 3SA on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
• Compliance with the Fair Credit Reporting Act (FCRA): 3SA Deliverables are investigative information products. They are not consumer reports under the FCRA and may not be used as a factor in eligibility for credit, employment, insurance, or housing decisions. If you require a regulated consumer report, obtain one from a FCRA-compliant consumer reporting agency.
• Secure Communications: You agree not to transmit sensitive case details over unsecured channels. 3SA directs Clients to use encrypted email (ProtonMail) for sensitive materials.

05 Payment Terms

3SA publishes current pricing on the Pricing and Services pages of the Site. Pricing may be revised from time to time; pricing in effect at the time of your purchase governs.

• Payment Processors: All payments are processed by secure third-party providers, including Stripe for booking and intake purchases. 3SA does not directly store full payment-card numbers.
• Deposits, Balances, and Tiers: Certain Services (notably Retrieval Work) require a deposit to begin work, with the balance due upon Deliverable delivery. Service-tier intake purchases are pay-in-full at intake.
• Earned-on-Commencement: Once 3SA has accepted an Engagement, intake data has been validated, and work has commenced, the fees paid for that Engagement represent the contracted value for the Services described at intake. Specific remedies for failed or partial performance by 3SA are governed by Section 7 (Disclaimers & Liability).
• Correct Tier Selection: You are responsible for selecting the correct service tier and confirming pricing prior to payment. Please review the Services, Pricing, and intake pages carefully before initiating payment.

06 Intellectual Property & Confidentiality

3SA Intellectual Property

The Site, including its design, copy, branding, OSINT methodologies, and the structure of our Deliverables, is the intellectual property of 3SA and is protected by U.S. copyright and trademark law. You may not reproduce, republish, or distribute Site content or Deliverable content for commercial purposes without prior written permission from 3SA.

Client License to Deliverables

Upon full payment for an Engagement, 3SA grants you a non-exclusive, non-transferable license to use the Deliverable produced for your specific Engagement for your internal lawful purposes (and, where you are an attorney, for the prosecution or defense of a specific legal matter on behalf of your client). You may not resell, sublicense, or publicly publish Deliverables.

Confidentiality

Each party agrees to keep confidential all non-public information received from the other party in connection with an Engagement, including intake details, Subject identifiers, and the contents of Deliverables, except as required by law, professional licensing rules, court order, or with the disclosing party's prior written consent.

07 Disclaimers, Liability, Termination & Indemnification

Disclaimer of Warranties

The Site and the Services are provided "as is" and "as available." 3SA disclaims, to the maximum extent permitted by law, all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 3SA does not warrant that any specific Deliverable will produce a specific legal outcome, locate a specific Subject, or be admissible in any particular forum.

Limitation of Liability

To the maximum extent permitted by law, 3SA's total aggregate liability arising out of or relating to an Engagement, the Site, or these Terms shall not exceed the total amount actually paid by Client to 3SA for the specific Engagement that is the subject of the claim. In no event shall 3SA be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost business opportunity, even if advised of the possibility of such damages.

Termination

• By Client: You may terminate an Engagement before work has commenced by written notice to 3SA at 3sa-llc@proton.me. Once work has commenced, the remedies set forth in Section 7 (Disclaimers & Liability) apply.
• By 3SA: 3SA may terminate an Engagement at any time for good cause, including but not limited to unlawful purpose, conflicting engagement, breach of these Terms, or conduct that threatens the safety or integrity of 3SA, its Clients, or third parties.
• Effect of Termination: Upon termination, 3SA will return or securely destroy Client-confidential materials as required by Section 6 and applicable law. Sections that by their nature should survive termination (Confidentiality, Limitation of Liability, Indemnification, Governing Law) shall survive.

Indemnification

You agree to indemnify, defend, and hold harmless 3SA, its members, and its representatives from and against any third-party claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or relating to (a) your breach of these Terms, (b) your unlawful use of the Site or the Services, (c) your misuse of any Deliverable, or (d) your violation of any applicable law or third-party right in connection with an Engagement.

08 Governing Law (Virginia) & Contact

Governing Law

These Terms, and any dispute or claim arising out of or in connection with them, the Site, or any Engagement, are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to any conflict-of-laws principles that would require application of the laws of any other jurisdiction.

Venue

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in the Commonwealth of Virginia, and the parties hereby consent to the personal jurisdiction of such courts.

Severability; Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with any written scope-of-work for an Engagement, constitute the entire agreement between you and 3SA with respect to the Services.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, technology, or applicable law. Any updates will be posted directly to this page with an updated "Last updated" date. Material changes will be highlighted at the top of the page for at least 30 days.
