INVESTIGATIVE SERVICES AGREEMENT & PERMISSIBLE PURPOSE CERTIFICATION

This Investigative Services Agreement ("Agreement") is entered into between 3SA Silver Stiletto Security Agency LLC ("3SA LLC") and the client submitting this intake form ("Client"). By submitting this form and engaging 3SA LLC's services, Client agrees to the following terms:

1. Lawful Permissible Purpose Certification

Client certifies that the request for investigative services is made for a lawful permissible purpose as selected in Section C of this intake form. Client further certifies that the requested investigation does not violate any applicable federal, state, or local law, including but not limited to the Fair Credit Reporting Act (FCRA), Gramm-Leach-Bliley Act (GLBA), Driver's Privacy Protection Act (DPPA), or any analogous state law.

2. FCRA Non-Applicability

Client acknowledges and agrees that:

  • The Digital Footprint Investigation is an investigative research report and is NOT a "consumer report" as defined under the FCRA.
  • This report may NOT be used for employment screening, credit decisions, housing eligibility, insurance underwriting, or any other purpose regulated under the FCRA.
  • Client will not use this report in any manner that would require compliance with FCRA requirements.

3. Point-in-Time Nature of Report

Client acknowledges that the Digital Footprint Investigation represents a point-in-time snapshot of publicly accessible information compiled through open-source intelligence (OSINT) methods. 3SA LLC makes no guarantees regarding the completeness, accuracy, timeliness, or comprehensiveness of any finding. Digital information changes constantly; a report may become outdated immediately after delivery.

4. Data Retention & Confidentiality

3SA LLC will retain intake data and investigative findings securely for a period not to exceed 12 months following delivery of the final report, unless otherwise required by law. Client data will not be sold, shared with third parties for marketing purposes, or disclosed except as required to perform the requested investigation or as legally compelled.

5. Limitation of Liability

3SA LLC's liability for any claim arising from services rendered shall not exceed the total fees paid by Client for the specific service giving rise to the claim. 3SA LLC shall not be liable for indirect, consequential, incidental, special, or punitive damages, including but not limited to lost profits, loss of data, or reputational harm, regardless of whether such damages were foreseeable or whether 3SA LLC was advised of the possibility of such damages.

6. Client Responsibilities

Client is solely responsible for ensuring that the use of any findings or report obtained through 3SA LLC's services complies with all applicable laws, regulations, and third-party terms of service. Client shall not use any finding to commit, facilitate, or further any unlawful act.

7. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any dispute arising from this Agreement shall be resolved exclusively in the courts of the Commonwealth of Virginia. Client consents to the exclusive jurisdiction of Virginia courts for any legal matter arising from this engagement.

8. Entire Agreement

This Agreement, together with the intake form and any applicable service order, constitutes the entire agreement between Client and 3SA LLC with respect to the services described herein. No prior representations, promises, or agreements not contained herein shall be binding unless agreed to in writing by both parties.

Permissible Purpose Acknowledgment

Client specifically acknowledges that the purpose selected in Section C of the intake form has been truthfully declared and that 3SA LLC relies on this certification in agreeing to perform the requested investigation. Any misrepresentation of purpose may render this Agreement void at 3SA LLC's sole discretion, and Client may be responsible for any resulting legal exposure to 3SA LLC.
